    美国国土安全部近日发布一项最终规则并同时征求意见，计划扩大对非美国公民在入境与离境过程中的人脸识别采集范围。规则指出，边境执法人员可在出入境口岸要求拍摄非公民照片，并将相关生物识别数据保存最长 75 年。

    规则取消了以往对采集地点与试点规模的限制，允许在机场、陆路口岸、海港以及其他获得授权的离境点实施。官方明确将分阶段推进，涉及陆路出入境和海港离境等场景的具体做法将另行公告。美国公民则可自愿参与，相关照片将在身份验证完成后 12 小时内删除。规则定于 2025 年 12 月 26 日生效，同时向社会征求意见的截止时间为 2025 年 11 月 26 日。

    “In this final rule, DHS is amending the regulations to provide that all aliens may be required to be photographed upon entry and departure from the United States. See8 CFR 215.8(a), and 235.1(f). Failure to comply with a requirement to be photographed may result in a determination of inadmissibility or a violation of the terms of the alien's status where CBP requires this information to determine identity or other immigration information.”
    本最终规则中，国土安全部（DHS）对相关法规作出修订，规定所有外国人入境美国及自美国出境时，可被要求接受拍照。参见《联邦法规汇编》第8编第215.8(a)条及第235.1(f)条。如海关及边境保护局（CBP）为确定身份或其他移民信息而要求提供该等信息时，未遵从拍照之要求者，会被认定为不予准入，或被认定为违反其外国人身份条件。
